OCCUPANCY LIMITS IN THE CITY OF ST.

PAUL
The St. Paul Legislative Code (Sec. 34.13) sets limits on the number of people who may occupy
a residential housing unit. For families (with related adults) the code is based on total habitable
room area or gross floor area (square footage). For unrelated adults the maximum number of
occupants is 4, even if the house is huge.

Areas which must be included are: living, eating, cooking and sleeping rooms. Areas which do
not have to be included are bathrooms, closets, hallways, laundry rooms and storage areas.

The first requirement which must be met is a minimum square footage for the entire unit (minus
the exceptions listed above). You must have 150 square feet for the first occupant, and 100
square feet for each additional occupant.

In addition to the square footage of the entire unit, there is also a restriction relating to the square
footage of each bedroom. A bedroom must be at least 70 square feet for occupancy of one
person. For two or more occupants there must be at least 50 square feet per occupant. For
example: A bedroom that is 9 x 12 = 108 square feet which = 2 occupants. A bedroom that is
12 x 13 = 150 square feet which = 3 occupants.

There are no laws which regulate the age, sex or number of children who can occupy a bedroom,
other than the occupancy limits stated above in the St. Paul Legislative Code, which applies to
any occupant regardless of age.

For Example:
A 4 bedroom house with rooms this size has a maximum occupant limit of 9.
