DUTERTE ADMINISTRATION ON THE CAMPAIGN OF ILLEGAL DRUGS:ITS

EFFECT TO THE PHILIPPINES AS A DEMOCRATIC COUNTRY


President Rodrigo Duterte shocked the world with his political strongman style,
vowing to wipe out crime within six months. His formula for dealing with criminals and
corrupt officials was simple: kill them all. He brushed aside domestic and
international criticism of his record of extra-judicial killings and human rights violations
as mayor of Davao City, saying he had no time for political correctness.
Police Power as defined under the law is the power of the state to enact and
enforce laws and to regulate property and liberty in the promotion of the general
welfare of the people. It is the power to regulate the behavior or conduct of its citizen
in the interest of the common good within the limits of the states law. It is vested in
the national legislature. Pursuant however to validity delegated legislative authority,
the president and the administrative bodies, as well as law making bodies og LGUs
may exercise the power under the general welfare clauses.
We believe that, the present drug campaign under the Duterte administration is
a valid exercise of Police Power but the methods used to carry out such were not
already within the limits set by law and the approach it took is being counter
productive and savage. Recognizing government efforts to fight criminality as part of
police power of the state, we cannot condone these acts of vigilantism and apparent
disregard to life and due process of our fellow Filipinos. It seems that it would be
better if they will push first Decriminalization and rehabilitization. Many were deprived
of their rights. While it may be true that they really did wrong and they needed to be
punish, they must not be denied the due process of law. The executive branch is and
should always be the vanguard of due process rights of individuals. As enforcers of the
law, it is incumbent upon the executive branch to make sure that protocols and
procedures reflect the respect for the due process rights of individuals,
These druglords, users, pushers and protectors are also citizens of the
Philippines and they were also given the same right as the president. They must then
be brought before the court and let the latter do its function. It cannot be left within
the president himself only for we are living within a democratic society and as a rule
the will of the people is paramount. "Wars" against drugs are unwinnable, and that the
President has turned his back on the humanitarian angle that he seemed to push in
Davao, which was to treat drug use as an illness and mental health issue, rather than
a safety and security issue. Furthermore, together with this, the number of victims of
extra judicial killing became much higher. An extrajudicial killing is the killing of a
person by governmental authorities without the sanction of any judicial proceeding or
legal process. Extrajudicial punishments are mostly seen by humanity to be unethical,
since they bypass the due process of the legal jurisdiction in which they occur.
Another is that we don't think this strategy is going to work long term. Let's be
honest: this strategy has been pursued in Davao for over a decade, and there are still
drugs there, and crime rates there are still comparable to the rest of the country. What
will happen after the Duterte ADMINISTRATION? Can we assure that drugs will no
longer be a problem? Why not decriminalize the using,selling and protecting such as
what other countries were doing which they find more effective.

"War on drugs" being waged by Duterte "has rapidly spiraled into a frenzied
campaign of extra-judicial killings and vigilante murders perpetrated by the police and
by police-linked criminal syndicates."nearly 1,000 people have been killed in just a
little more than one month. Hundreds have been killed while 'resisting arrest' or while
under custody and detention, in police cars as well as in jails. Human rights are being
"violated with impunity by police personnel" who they argued were "emboldened by
Dutertes assurances of 'I got your back' and his public declarations of contempt
against human rights. Duterte administration has unleashed unmitigated violence and
threats of violence against the people, mostly victims and people at the lowest rungs
of the criminal syndicate ladder. Meanwhile, suspected high-profile drug lords and
their protectors are afforded courtesy calls to Malacaang, accommodations in Camp
Crames guest house, and preliminary investigations by the NBI. Releasing a list of
supposed drug protectors and narco-politicians "without proof nor clear basis for
accusations of their involvement in drugs violates ones right to be presumed
innocent. These were just some of the acts performed by president Duterte and
behind this acts were the rights of the victims being deprived. It seems that, yes we
can feel and see the results and change but along with it are the denial of due process
of law and deprivation of ones life and rights without being accorded the justice they
deserve.
It's not about deciding who dies or who lives. It's also about making sure that
when the fighting dies down, what's left is a community that trusts more than fears.
The most effective way of waging war against drugs is by rousing the people and
mobilizing them to become active participants in social revolution. As Archbishop
Socrates Villegas, president of the Catholic Bishops' Conference of the Philippines said
fighting drug addiction couldn't justify the deaths. Are we providing our children a
safe haven, by teaching them by our tolerance of murders, that killing suspected
criminals without fair hearing is a morally acceptable way to eradicate crime? "From a
generation of drug addicts shall we become a generation of street murderers?"
