iii. Implied Condition That The Goods Be Of Acceptable Quality s54
1. Where a person supplies the goods in trade or commerce,
there is a guarantee the goods are of acceptable quality
under s54 of the ACL
a. They are of acceptable quality if
i. Fit for all purposes that it is commonly used
for
ii. Acceptable in appearance and finish
iii. Free from defects
iv. Safe
v. durable
2. Goods should be of acceptable quality unless:
a. Defects of the goods are drawn to the consumers
attention; or
b. There has been an examination of the goods before
purchase which would have revealed the defect
that actually exists s54(4)
i. The examination is clearly the actual
examination undertaken by the buyer, if any,
and not the examination a reasonable buyer
would make (Truck Wreckers)
1. i.e. subjective test
3. Are the goods of acceptable quality?
a. The goods must be reasonably fit for all the
purposes which they are normally bought, having
regard to any description, price, condition and age
(s54(2))
i. This is an objective test.
ii. If the description of the goods excludes some
purpose, then it need not be fit for that
purpose (Rasell)
4. Remedy for breach:
a. Acceptance of the goods is whether it is a major
breach or minor breach, unless
i. Goods disposed of by buyer, were lost, or
destroyed (otherwise than by a defect in the
goods)
ii. Consumer caused good to become
unacceptable
iii. Goods used abnormally by consumer 254(6)
b. Can rescind within a reasonable time after having
reasonable opportunity to inspect the goods
5. S54 only applies to the sale of goods and not sale of
services
iv. Implied Condition That The Goods Will Be Fit For Their Purpose s55(1)
1. The buyer must have made known, expressly or by
implication to the supplier or a person prior to
