LEGAL APTITUDE

Question 1
Principle: Volenti non fit inj uria , a well -established legal principle, means that a
person has no legal remedy for the injury caused by an act which he has consented.
Fact: An old l ady was walking i n a narrow one-way lane in the opposite direction. It
was nighttime and there was no street l ighting. A car moving in ri ght direction but
without headlights knocked her down since the driver could not see her. She fi led a
suit against the dri ver.

Question 2
Principles:
1] Negli gence is the omission to do something, which a reasonable man would do,

affected by the breach of duty.
3] One is not liable if i njured party volunteers to take the risk.
Fact: A cricket match is being held in a stadium. X, being unable to afford the ti cket
price, i s vi ewing the cri cket match sitti ng atop a branch of a nearby tree. When a
batsman hits a ball over the boundary, the ball in turn hits A and sustains injury on
hi s spinal chord due to fall from the tree.

Question 3
Principle: A person has no remedy against an injury caused by an act to which he has
consented.
Fact: Raj was i n a hurry to get to the ai rport to catch the plane and he hi red a taxi run
by Capi tal Taxi Company, well known in that locali ty. Raj asked the driver to drive
fast. In the ci ty zone, there was a speed l imi t of 60 km per hour and the driver, rather
rel uctantl y, drove quite fast at times 90km per hour to reach the airport in time. As a
result, the driver lost control and hi t an obstacle and Raj was badly injured. Raj fil ed a
suit against the Taxi Company.

ran out and bit Mr. Kauls overcoat. Mr. Kaul turned around and raised the pistol
when the dog was running away. Mr. Kaul knew that the dog had attacked so many
other people in that l ocality of Jammu.
Mrs. Mattoo clai ms that her dog was of a rare breed and i t was worth Rs.5000/- She
is planni ng to bri ng a legal action against Mr. Kaul for compensati on.

out of the house and fired at fleeing robbers who by that ti me mingled with the

Mahesh. Roopa was thrown out of the car and suffered multi ple injuries. She seeks

HMT happened to stop nearby and number of people got into the bus. M, without
realizing that it was HMT bus, got into the bus and soon thereafter, the bus met wi th
an accident due to drivers negligence. M, along with several others, was inj ured in
the acci dent. M seeks to file a sui t against HMT claiming damages.
