Section 1: Narrative
On June 02, 2014, at approximately 1045 hours, 1 was assigned to Courtroom3C, at the Moore Justice Center,
2825 Judge Fran Jamieson Way, Viera, Brevard County, Florida, in reference to providing court security for
Judge John Murphy (Involved - 1) .
Judge Murphy was seated at the bench and the Assistant Public Defender, Mr. AndrewWeinstock Qnvolved - 2) ,
was standing at the podium. Judge Murphy and Mr. Weinstock were having a disagreement over several cases.
At one point, Judge
Murphy
said to Mr. Weinstock " If 1 had a rock, 1' d throwit at you". He then told Mr.
Weinstock to "
stoppissing
me off" and " sit down, 1 don' t need your
help,
1' ll take care of this". At this
point, Mr. Weinstock became more argumentative, stating " 1' mthe Public Defender and 1 have a right to be
here and 1 have a right to stand and represent
my
clients".
Judge Murphy again told Mr. Weinstock to sit
down, but he just stood his ground. At this point, Judge Murphy stated " If you want to fight, let' s go in
the back and I' ll beat your ass".
Mr. i'einstock immediately stated " let' s go out back" and he quickly
stepped towards the back hallway. The two of themthen exited the courtroomand stepped into the back
hallway. Seconds later, I stepped intothe back hallway and sawthe two of themgrabbing ahold of each
other's suitcoat, pushing eachother back and f'orth. I heardJudge Murphy say " Do you wanna fuck withme, do
you?" and I heard Mr. Weinstock
say "
alright".
1 immediatelv stepped in and separated the two of' themas they
still had a grasp on eachother. They disengaged and Judge Murphy went back intohis courtroomas Mr.
Weinstock was escorted to a nearby jury deliberation roomby Deputy Martinez. 1 then contacted a supervisor
to respond.
Sergeant McNatt and Lieutenant Cullen arrived on scene shortiv thereafter. Sergeant McNatt escorted Mr.
Weinstock to his office on the tirst tloor to await the arrival of Public Defender Blaise Trettis. It should
be noted that neither party provided a statement during the initial contact in regard to this incident and no
statements were provided during a subsequent contact the following day. Bothparties indicated that they did
not wish to pursue this matter any further.

The crime scene in this case is located in the rear haliway of the third tloor, behind courtroom3C, located
at the Moore Justice Center at 2825 Judge Fran Jamieson Way in Viera, Florida.
I examined Mr. Weinstock for visible injuries and none vere observed. Likewise, no injuries were observed on
Judge Murphy.
Acopy of the surveillance video for courtroom3Cwas obtainedto include footage of a few minutes before the
incident and a fewminutes af'terwards, and will be included as an enclosure. No video is available for the
back hallwav behind courtroom3C.

This case is closed, exceptionally cleared, and referred to tile as both parties do not nishto pursue the
matter any further.

Section One: Narrative
On June 2, 2014, while working at 2825 Judge Fran Jamieson Way, Viera, Brevard County, Florida, as a court
deputy n courtroom3D, 1 heard a loud disturbance in the back Judges' hallway.
I responded frommy courtroomto investigate the disturbance in the hallway. Upon mv arrival, I witnessed
Judge Murphy place Assistant Public Defender, AndrewWeinstock, up against the back hallway wall. Both men
were gripping each other around the upper collar of their suit jackets. Both men were screaming at each
other. Deputy Bryon Griffin intervened between the men and physically separated them.
1 escorted Mr. Weinstock to a nearby deliberation roomand a supervisor was contacted to respond.
Section Two: Crime Scene
The crime scene in this case is located in the back hallway on the third floor of' the Moore Justice Center
located at 2825 Judge Fran Jamieson Way in Viera, Florida. No crime scene processing was completed by this
deputy.
