The Specification takes precedence over the drawings, but should any deviation be discovered between the two documents the Contractor must immediately inform the Construction Manager to resolve any differences. 11. Any drawing and or Specification which may be issued/revised after the tender, these may be in the form of addendum bills of quantities and/or variation instructions. The rates provided within the Bills of Quantities will be used to establish adds and/or omissions of the agreed Lump Sum bid/Contract. 12. All queries or doubts should be discussed during the pre-tender meetings. 13. If there will be any changes in the Drawing and/or Specifications issued through official Construction Manager's Instruction "CMI", the changes will be evaluated for the effected design versus Contracted works only, entirely re-measure based on revised design to derive cost impact will not be considered. 14. For new items of a dissimilar character and being carried out under similar conditions with significant deviation the agreed BOQ rates, Contractor to provide full substantiations including supplier's quotations, cost breakup and new unit rates analysis for the Engineer's review. In accordance to Clause 12.3 (Evaluation) of the Particular Conditions, 15% overhead and Profit will be considered. 15. There might be a numbers of value engineering to be implemented through the Construction period to meet the Project Budget Requirement and substantial cost reduction is anticipated. It is Owner's decision to make changes as he sees fit, and the Contractor shall not be entitled to claim for any damage, loss, expenditure arising as a direct and/or indirect consequence of the value engineering/cost reduction exercise. 16. The value engineering/ cost reduction to be notified through Construction Manager's Instruction "CMI" when it decides and Cost impacts arising thereon to be evaluated in accordance with Clause 13 [Variations and Adjustments] of the Conditions. Hence, the unit rates stipulated in the Bills of Quantities are not subject to adjustment irrespective of such increases or additional expenditure coming into effect as a result of the value engineering/cost reduction during the progress of the works.
