Judge: ATTACHMENT “A” The following Affidavit is made in support of the request for the issuance of a Search Warrant for:_Any and all motor vehicles locat. n_the property whict y contain evidence to include a 2001 green Dodge Stratus VIN# 1B3EJ46XZ1N518288 with a Colorado Temporary plate of 479597J located in the rear window. All of which is located in the unincorporated area of the County of Teller, State of Colorado ‘Your Affiant is Detective R.N. Olmsted, a regularly employed swom deputy sheriff for the County of Teller, State of Colorado. Your Affiant has been a law enforcement officer in the State of Colorado since May 1983. Your Affiant carries a U.S. Customs, and a FBI designation. ‘Your A ffiant has attended classes concerning Major Crimes and Incidents, Crime Scene investigation, Homicide investigation, Sex Crimes investigation, Narcotics investigation, and Evidence collection to include DNA recovery. Your Affiant has written hundred’s of search and arrest warrants, which have resulted in the recovery of stolen property and the arrest of numerous criminals, Your Affiant is a Certified Child Forensic interviewer, and has attended the Reid Interview and Interrogation school. Your Affiant has attended trainings in Internet tools for Criminal Investigators, Identity Theft, Amber Alert, Counterdrug, Linguistic Statement analysis, Clandestine Jab course, False Identification documents, Gunshot wounds, Hostage Negotiation, Gang identification, and Swat schools. Your Affiant attends approximately 200 hours of on the job training each year. * Information relating in this case is depicted in Teller County Sheriff's Case number 11-0604. On February 23, 2011, Your Affiant was contacted by Homicide detective Rick Gysin with the Colorado Springs Police Department in reference a missing 6 year old boy namcdellimg Detective Gysin was asked to assist the Durham North Carolina Police Department in the location of zis Detective Robinson at the Durham Police Department requested that Detective Gysin attempt colntact with Salimews grandparents who live in the Colorado Springs Metro Area. Detective Gysin was advised that sam mother ,Vania Rac Sisk, SSE hod left Durham North Carolina with a group of Black Hebrew followers in route to Colorado. Detective Gysen informed Your Affiant that the Durham Police Department Investigators had advised him that Vania Sisk had left North Carolina with only three of her four children Detective Gysen requested that Your Affiant respond to the address of 205 East Ridge Drive located in the unincorporated area of the County of Teller, State of Colorado, Detective Gysin requested that Your Affiant, not make contact with the people at the residence but that Your Affiant locate any and all vehicle license plate information on or around the property. While en-route to that location, Your Affiant was recontacted by Detective Gysin who informed Your Affiant that there would very likely be a “moving” type vehicle in the driveway. Your Affiant arrived at 205 East Ridge Road and verified that there was a moving van and a dark green Dodge Passenger vehicle in the driveway. Your Affiant observed a black male and a Hispanic female unloading items from the trunk of the Dodge passenger vehicle. Your Affiant estimated the black male to be approximately 5°06" tall and approximately 180 pounds wearing a black jacket with the letters “LA” in white on the rear of the jacket. Your Affiant left the area and contacted Detective Gysin and confirmed the vehicles were at the address of 205 East Ridge Rd. Your Affiant informed Detective Gysin that Your Affiant had observed the black male and Hispanic female. Detective Gysin stated that the description of the people in the driveway at 205 Ridge Road matched the description of the people he was looking for. On February 23, 2011, Investigators from the Colorado Springs Police Department met with deputies at the Teller County Sheriff's Office the purpose of which was to attempt to locate igual Colorado Springs investigators bad previously uncovered information that Vania Sisk had used her “EBT” card at Wal- Mart located in Woodland Park. Investigators informed loss prevention thet they were attempting to locate Vania Sisk. Colorado Springs investigators gave Wal-Mart loss prevention photographs of Vania Sisk. During the briefing with investigators and deputies, Wal-Mart loss prevention contacted them and told them that Vania Sisk was at the Wal-Mart with four other individuals all similarly dressed and walking around the store together, Investigators at that juncture split, some going to Wal-Mart and others going to 205 East Ridge Drive. Investigators at Wal-Mart specifically Detective Mark Enomoto spoke with Vania Sisk. Vania Sisk told him that her three children were at a house in Woodland Park however she did not know the address in which they just moved into from Durham North Carolina. Vania Sisk told Detective Enomoto that they had moved from 2109 Pear Tree Lane in Durham North Carolina, While investigators were speaking with Vania Sisk, P, Leonard Moses, Devin Gerald, Giovanna McCrae and Shelia Moses, investigators told the group that they had orders from the department of human services in Durham North Carolina to take custody of all the children living in the household at 205 East Ridge Drive. At that point in the interview one of the females stated and pointed at Viana Sisk, “We are losing all of our kids cause you don’t know where one of yours is." Investigators learned through interviews with individuals at Wal-Mart and at 205 East Ridge Drive that the following adults lived at 205 East Ridge Drive, Viana Sisk, Peter Moses, P. Leonard Moses, Devin Gerald, Giovanna McCrae, Shelia Moses, Lavada Harris, LaRonda Smith and Margaret Colon-Rivera, Investigators that went to the 205 East Ridge Drive spoke with LaRonda Smith. Investigators were invited into the residence. The investigators explained to LaRonda Smith that they were there to confirm that “Weaeaae vas alive and at the residence. Investigators searched the interior of the residence and were unable to locate the 6 year old little boy know asl. Teller County Department of Social Services was present at the residence and took custody of 10 children at 205 East Ridge Drive, three of which were Viana Sisk’s children. All of the adults were informed that they must attend a meeting at 8:30 A.M. the following morning, Thussday February 24, 201 | at the Teller County Department of Social Services so that they may be informed as to the procedure of returning the children back to them. At approximately 9:00 A.M. the Teller County Department of Social Services received a phone call from one of the females at the residence stating that they would be late to the meeting. At 11:30 A.M, all of the adults appeared at the Department of Social Services except for Vania Sisk. Petter Moses told the social worker they got up the morning of the 24" and Vania Sisk was gone leaving a note behind, Peter Moses gave the intake worker @ letter possibly written by Vania Sisk, stating that she was sorry and she was leaving with lie ‘On February 25, 2011, Your Affiant was contacted by Detective H.M. Velasquez of the Colorado Springs Police Department who stated that the Durham Police Department had advised him they had received information from a confidential informant who was a former member of this group of Black Hebrew followers, who had escaped from the group. This individual informed the Durham Police Investigators that the informant was present in the residence of 2109 Pear Tree Lane which is located in the City of Durham, North Carolina, in October of 2010 when Peter Moses became extremely angry at the 6 year old boy diate MMB The Individual informed the investigators that Peter Moses had grabbed a gun and began pacing angrily around the house. The informant heard Peter Moses call for the 6 year old boy @QsAaMa@WUR, to the basement 4 and then heard loud music and the sound of a gunshot. The individual did not sec ll until the informant observed the deceased boys body being wrapped in plastic and placed into a suitcase by Peter Moses then placed into the attic of the residence. The informant told investigators that several days later the body began to stink and Peter Moses was asked to remove the body, which he did, Your Affiant contacted Detective Robinson from the Durham Police Department who relayed the following information which he had heard first hand form the confidential informant. Two weeks ago at the residence in North Carolina, Antoinetta McKoy, another member of the Black Hebrew followers, got into a heated argument with Peter Moses over car keys that could not be found. Antoinetta ran out from the residence and flagged down a female passer-by and requested help. Antoinetta entered into the car and two females from the residence came out and told the passer-by that everything was okay and escorted Antoinerta back to the residence with them. Once inside the residence the two females began to beat Antoinetta unconscious. Peter Moses came to the area where Antoinetta was located and gave a .22 caliber gun to Vania Rae Sisk and told her to keep Antoinetta there. Peter Moses gave LaRonda, another member of the Black Hebrew Followers, a 9mm handgun and told her to watch both of them. Peter Moses retuned later and Vania Sisk had the 9mm handgun and Peter Moses told her to shoot Antoinetta, which Vania Sisk did. Peter Moses then assisted both females in removing Antoinetia from the house and buried her. On February 25, 2011, Investigator David Guest of the Fourth Judicial District Atomey’s Office spoke with Myca Bradford the supervisor of the investigation unit of child protective services in North Carolina. She stated that Vania Sisks’ electronic benefit tansfer card (EBT) had not been used anywhere since it was used on February 23, 201 |, in the evening at the Wal-Mart in Woodland Park Colorado, As of today’s date and time, sili Vania, and Antoinetta have not been located and are missing. The ‘weapon possibly used in the murder of Antoinetta and damiggehas not been located either in Nosth Carolina or Colorado. SllMhas not been scen in Colorado with the occupants of 205 Ridge Drive or observed by any employees of the Department of Social Services. The former occupants of 2109 Pear Tree Lane, Durham, North Carolina moved themselves and contents to 205 Ridge Drive within the last week. Along with the missing persons, clothing, suitcases and the murder weapon, there may also be samples of Vania's handwriting located at 205 Ridge Drive that can be used to compare the handwriting on the note provided by Peter Moses to the Department of Social Services. All of which is located in the unincorporated area of the County of Teller, State of Colorado ‘Your Aftiant is Detective R.N. Olmsted, a regularly employed sworn deputy sheriff for the County of Teller, State of Colorado. Your Affiant has been a law enforcement officer in the State of Colorado since May 1983 Your Affiant carries a U.S. Customs, and a FBI d Your Affiant has attended classes concerning Major Crimes and Incidents, Crime Scene investigation, Homicide investigation, Sex Crimes investigation, Narcoties investigation, and Evidence collection to .clude DNA recovery. Your Affiant has written hundred’s of search and arrest warrants, which have resulted in the recovery of stolen property and the arrest of numerous criminals. Your Affiant is a Certified Child Forensic interviewer, and has attended the Reid Interview and Interrogation school Your Affiant has attended trainings in Intemet tools for Criminal Investigators, Identity Theft, Amber Alert, Counterdrug, Linguistic Statement analysis, Clandestine lab course, False Identification documents, Gunshot wounds, Hostage Negotiation, Gang identification, and Swat schools. ‘Your Affiant attends approximately 200 hours of on the job training each year. Information relating in this case is depicted in Teller County Sheriff's Case number 11-0604. On February 23, 2011, Your Affiant was contacted by Homicide detective Rick Gysin with the Colorado Springs Police Department in reference a missing 6 year old boy named Sag. Detective Gysin was asked to assist the Durham North Carolina Police Department in the location ofa Detective Robinson at the Durham Police Department requested that Detective Gysin attempt contact with seammie cranciparents who live in the Colorado Springs Metro Area. Detective Gysin was advised thas mother ,Vania Rae Sisk, DOB: 06/30/1985 had left Durham North Carolina with a group of Black Hebrew followers in route to Colorado. Detective Gysen informed Your Affiant that the Durham Police Department Investigators had advised him that Vania Sisk had left North Carolina with only three of her four children Detective Gysen requested that Your Affiant respond to the address of 205 East Ridge Drive located in the unincorporated area of the County of Teller, State of Colorado. Detective Gysin requested that Your Affiant not make contact with the people at the residence but that Your Affiant locate any and all vehicle license plate information on or around the property. While en-route to that location, Your Affiant was recontacted by Detective Gysin who informed Your Affiant that there would very likely be a “moving” type vehicle in the driveway. Your Affiant arrived at 205 East Ridge Road and verified that there was a moving van and a dark. green Dodge Passenger vehicle in the driveway. Your Affiant observed a black male and a Hispanic female unloading items from the trunk of the Dodge passenger vehicle, Your Affiant estimated the black male to be approximately 5°06" tall and approximately 180 pounds wearing a black jacket with the letters “LA” in white ‘on the rear of the jacket. Your Affiant lefi the area and contacted Detective Gysin and confirmed the vehicles were at the address of 205 East Ridge Rd. Your Affiant informed Detective Gysin that Your Affiant had observed the black male and Hispanic female. Detective Gysin stated that the description of the people in the driveway at 205 Ridge Road matched the description of the people he was looking for. On February 23, 2011, Investigators from the Colorado Springs Police Department met with deputies af the Teller County Sheriff's Office the purpose of which was to attempt to locate SAINI, Colorado Springs investigators had previously uncovered information that Vania Sisk had used her “EBT” card at Wal- Mart located in Woodland Park. Investigators informed loss prevention that they were attempting to locate Vania Sisk. Colorado Springs investigators gave Wal-Mart loss prevention photographs of Vania Sisk. During the briefing with investigators and deputies, Wal-Mart loss prevention contacted them and told them that Vania Sisk was at the Wal-Mart with four other individvals all similarly dressed and walking around the store together. Investigators at that juncture split, some going to Wal-Mart and others going to 205 East Ridge Drive. Investigators at Wal-Mart specifically Detective Mark Enomoto spoke with Vania Sisk. Vania Sisk told him that her three children were at a house in Woodland Park however she did not know the address in which they just moved into from Durham North lina. Vania Sisk told Detective moto that they had moved from 2109 Pear Tree Lane in Durham North Carolina. While investigators were speaking with Vania Sisk, P. Leonard Moses, Devin Gerald, Giovanna McCrae and Shelia Moses, investigators told the group that they had orders from the department of human services in Durham North Carolina to take custody of all the children living in the household at 205 East Ridge Drive. At that point in the interview one of the females stated and pointed at Viana Sisk. “We are losing all of our kids cause you don’t know where one of yours is. Investigators learned through interviews with individuals at Wal-Mart and at 205 East Ridge Drive that the following adults lived at 205 East Ridge Drive, Viana Sisk. Peter Moses, P. Leonard Moses, Devin Gerald. Giovanna MeCrae, Shelia Moses, Lavada Harris, LaRonda Smith and Margaret Colon-Rivera Investigators that went to the 205 East Ridge Drive spoke with LaRonda Smith. Investigators were invited into the residence. The investigators explained to LaRonda Smith that they were there to confirm that Je@NM was alive and at the residence. Investigators searched the interior of the residence and were unable to locate the 6 year old litte boy know 2s (@@@iBillie=T'eller County Department of Social Services was present at the residence and took custody of 10 children at 205 East Ridge Drive, three of which were Viana Sisk’s children. All of the adults were informed that they must attend a meeting at 8:30 A.M. the following moming, Thursday February 24, 2011 at the Teller County Department of Social Services so that they may be informed as to the procedure of returning the children back to them. At approximately 9:00 A.M. the Teller County Department of Social Services received a phone call from one of the females at the residence stating that they would be late to the meeting, At 11:30 A.M. all of the adults appeared at the Department of Social Services except for Vania Sisk. Petter Moses told the social worker they got up the morning of the 24" and Vania Sisk was gone leaving a note behind. Peter Moses gave the intake worker a letter possibly written by Vania Sisk, stating that she was sorry and she was leaving with On February 25, 2011, Your Affiant was contacted by Detective H.M. Velasquez of the Colorado Springs Police Department who stated that the Durham Police Department had advised him they had received information from a confidential informant who was a former member of this group of Black Hebrew followers, who had escaped from the group. This individual informed the Durham Police Investigators that the informant was present in the residence of 2109 Pear Tree Lane which is located in the City of Durham, North Carolina, in October of 2010 when Peter Moses became extremely angry at the 6 year old boy daa ‘sMter='The Individual informed the investigators that Peter Moses had grabbed a gun and began pacing angrily around the house. The informant heard Peter Moses call for the 6 year old boy SMMJM&. to the basement 4 and then heard loud music and the sound of a gunshot. The individual did not sec SII until the informant observed the deceased boys body being wrapped in plastic and placed into a suitcase by Peter Moses then placed into the attic of the residence. The informant told investigators that several days later the body began to stink and Peter Moses was asked to remove the body, which he did. ‘Your Affiant contacted Detective Robinson from the Durham Police Department who relayed the following information which he had heard first hand form the confidential informant. Two weeks ago at the residence in North Carolina, Antoinetta McKoy, another member of the Black Hebrew followers. got into a heated argument with Peter Moses over car keys that could not be found. Antoineita ran out from the residence and flagged down a female passer-by and requested help. Antoinetta entered into the car and two females from the residence came out and told the passer-by that everything was okay and escorted Antoinetta back to the residence with them. Once inside the residence the two females began to beat Antoinetta unconscious. Peter Moses came to the area where Antoinetta was located and gave a .22 caliber gun to Vania Rae Sisk and told her to keep Antoinetta there. Peter Moses gave LaRonda, another member of the Black Hebrew Followers, a 9mm handgun and told het to watch both of them. Peter Moses returned later and Vania Sisk had the 9mm handgun and Peter Moses told her to shoot Antoinetta, which Vania Sisk did. Peter Moses then assisted both females in removing Antoinetta from the house and buried her. On February 25, 2011, Investigator David Guest of the Fourth Judicial District Attomey’s Office spoke with Myca Bradford the supervisor of the investigation unit of child protective services in North Carolina, She stated that Vania Sisks* electronic benefit transfer card (EBT) had not been used anywhere since it was used on February 23, 201 1, in the evening at the Wal-Mart in Woodland Park Colorado. As of today's date and timerfiimy Vania, and Antoinetta have not been located and are missing. The ‘weapon possibly used in the murder of Antoinetta and¥@ilhas not been located either in North Carolina or Colorado. EM has not been seen in Colorado with the occupants of 205 Ridge Drive or observed by any employees of the Department of Social Services. The former occupants of 2109 Pear Tree Lane, Durham, North Carolina moved themselves and contents to 205 Ridge Drive within the last week. Along with the missing persons, clothing, suitcases and the murder weapon, there may also be samples of Vania’s handwriting located at 205 Ridge Drive that can be used to compare the handwriting on the note provided by Peter Moses to the Department of Social Services.
