This agreement is made between ___________________ herein
referred to as the stable and ______________________ herein
referred to as the boarder. This agreement constitutes the entire
agreement between the parties. Any modifications or additions
must be in writing and signed by all parties before a notary.

3. Fees, Terms and Locations

Payment of $ ___________ per horse per month is due by BOARDER


in advance by the first day of each month. STABLE agrees to
board the herein described horse at 3207 Boggs Rd, Zanesville
OH 43701 on a month to month basis commencing
_________________. Partial months shall be paid on a pro-rate based
on the number of days boarded in a standard 30 day month. Late
payments will have a $2.00 a day added to Fees. A $50.00
charge will be applied to fees in the cased of a bounced
check.
4. Termination
A written notice period of 30 days from the first day of the
month, submitted to the stable, will be required to terminate the
boarding agreement. Any shorter notice will cause forfeit of the
full months board fee- no prorating will be done. The stable
reserves the right to terminate the boarding agreement with 30
days notice. Conditions for possible termination include antisocial or violent behavior of horse towards other horses or stable
workers.
5. Standard of Care
1. Unless specific written arrangements are made with the
stable the medical care, shoeing, grooming, hoof cleaning,
exercising and training of the horse shall be the sole
responsibility of the boarder.
2. Grain, hay and supplements are to be supplied by the
boarder.
3. Stable will provide storage area for hay, grain and
supplements purchased by boarder.
4. Stable will feed, water and check on horse twice per day.
5. Care provided by the stable includes indoor stall with
bedding for bad weather and turn out on pasture with
shelter. Items provided by the stable include salt mineral
block, fresh water, feed pans, buckets and stall cleaning
equipment.

6. Horses will be turned out in selected groups. Turn out times


and paddocks used will be decided by the stable.
6. Stall stripping & bedding
If stall requires (determined by stable) or if owner requests
stripping more than once a week, there will be an additional
$20.00 per stripping added to board fees. If boarder wishes to use
a bedding other than what stable has available the boarder may
purchase bedding at boarders expense. Stable may use any of
the following types of bedding: pine, saw dust and/or straw
depending on availability and cost.
7. Blanketing
The stable will not be responsible for blanketing or removal of
blankets, should owner wish to use one.
8. Tack Boxes & Equipment
Boarders will be allowed to have one standard size tack box per
horse. It is recommended that it be kept locked when not in use.
The boarder will have use of a saddle rack (one per horse) in barn
tack area. Stable, staff and family are not responsible for
lost, stolen or damaged tack or equipment belonging to
boarder. Feed pans, buckets, forks, rakes etc are provided for use
to the boarder.
9. Emergency Care
The stable has the permission of the boarder to request a
veterinary, ferrier or dentist if the need arises urgently. This will
be done at the boarders expense. In an emergency the stable will
make every effort to contact the boarder but if unable to reach,
any decisions made by the stable in the absence of the boarder
will be made in the best interests of the horse.
All veterinary, ferrier and dentist costs are additional to the
boarding fees. Any veterinary, ferrier and/or dental charges are

the responsibility of the boarder, who will be billed directly by the


vet, ferrier or dentist for any charges. Should they expect
payment at time of service and boarder is unavailable, the stable
will pay charges and boarder will be expected to repay stable
within 24 hours of services preformed.

The stable shall implement a program of deworming


consistent with recognized standards. The boarder is
obligated to pay the expenses of such services which is
over and above the boarding fee.
11. Ownership/ Coggins
BOARDER warrants that it owns said horse and that there are no
liens against said horse expressed or implied by law. BOARDER
will provide prior to the time of delivery of said horse a negative
Coggins test current within the last twelve month period, and will
provide Coggins every twelve months at all times of boarding.
12. Risk of Loss
During the time that the horse is in the custody of the STABLE,
STABLE shall not be liable for any sickness, disease, theft, death
or injury which may be suffered by the horse. This includes, but is
not limited to, any personal injury or disability the horse may
receive while on STABLES premises. BOARDER fully understands
and hereby acknowledges that the STABLE does not carry
insurance on any horse not owned by STABLE, including, but not
limited to, such insurance for boarding or any other purposes for
which the horse is covered under any public liability, accidental
injury, theft or equine mortality insurance and that all risk relating
to boarding of horse or for any other reason for which the horse is
in the possession of STABLE are to be borne by the BOARDER.
13. Death of a horse
In the event of horses death, the boarder will have 24 hours after
notification of death to remove said horse from barn premises.
Should horse owner be unable or unwilling to remove remains in
the allotted time, there will be a $500.00 fee for disposal of said
horse should stable have to do so. Any horse tack, supplies or
second horse will be held until all fees are paid in full to satisfy
debts.

14. Hold Harmless


BOARDER agrees to hold STABLE harmless from any claim
resulting from damage or injury caused by said horse, BOARDER
or his guests and invitees, to anyone including but not limited to
legal fees an/or expenses incurred by STABLE in defense of such
claims.
WARNING
UNDER OHIO LAW, an equine activity sponsor, equine activity
participant, equine professional, veterinarian, ferrier or other
person is not liable in damages in a tort of other civil action for
harm that an equine activity participant allegedly sustains during
an equine activity and that results from an inherent risk of an
equine activity, pursuant to Ohio Revised Code Annotated
2305.321

15. Damages
BOARDER agrees to pay for all damages caused by said horse
including barn, fences, gates and tack if STABLE provides proof of
said horse. Upon presentation of receipts of repair BOARDER shall
have fifteen days to pay STABLE the balance.
16. Rules
Horse owner and guest of horse owner must agree to follow all
rules posted on barn premises (see list below). Violators will be
reminded of rules and on second offence may be asked to leave
barn premises.
Any children under the age of 18 must remain with
parent at all times.
Safety helmet must be worn by all riders under the age
of 18 (adults are recommended to wear a safety
helmet).

Do not feed, treat or remove from stall/field anyone


elses horse without the sole permission of the horse
owner in writing.
Only use your own tack and equipment. Use of another
boards tack and equipment requires permission of that
boarder.
No smoking on premise.
No one but horse owner will be allowed to remove
horse for any activity unless written permission is given
to stable by horse owner prior to removal of said horse
for any activity.
17. Hours of Operation
The barn is open between the hours of 7am and 7pm, 7 days a
week. The boarders must seek permission of stable to be on the
property outside of these hours. (Summer hours are extended
until 9pm unless otherwise posted on barn bulletin board)

19. Right of LIEN
BOARDER is put on notice that STABLE has and may assert the
right of lien, as provided for by the laws of the State of OHIO, for
any amount due for the boarding and keep of said horse and also
for any storage or other charges due. STABLE shall have the right,
without process of law, to attach lien to your horse after 2 months
of non-payment or partial payment and STABLE can then sell
horse to recover its loss.
20. Mediation/Aebitration by Equine Dispute Resolution
Service

In the event of a dispute or disagreement relating in any manner


whatsoever to the AGREEMENT the parties agree to engage in
mediation in an effort to resolve the dispute before either party
resorts to court action. Mediation shall be conducted by and
according to the rules of the Equine Dispute Resolution Service
(EDRS) and shall be commenced within 45 days of such
disagreement or the request of either party to mediation. In the
event that the parties are unable to successfully resolve the
dispute through mediation, then the parties agree to submit the
dispute to binding arbitration by and according to the rules of
EDRS within 30 days of any declaration of impasse by EDRS. THIS
AGREEMENT IS SUBJECT TO THE LAWS OF THE STATE OF OHIO.
