Fisheries Legal issues and International Law

The purpose of this document is: 1) to elucidate Antigua and Barbuda’s plan of action to prevent, deter, and eliminate illegal, unreported and unregulated (IUU) fishing; 2) to provide a status report on the nature and extent of IUU fishing with respect to Antigua and Barbuda; 3) to provide an account of the current policies and legislation relating to this problem; and 4) to identify ongoing strategies and programmes to address it.

The topic’s examination will develop as follows: section 2 will provide preliminary comments on the definition and status of ‘ship without nationality’ under international law; section 3 will examine some of the rules in place at international and regional legal levels on fisheries enforcement against stateless vessels operating on the high seas; and finally, section 4 will wrap up the discussion and draw some conclusions based on the research’s finding. This article will not deal with vessels without nationality other than fishing vessels.

The ‘Associazione di Consulenza in Diritto del Mare’ (ASCOMARE) is pleased to launch the call for papers for the  Second Volume of its Yearbook on the Law of the Sea (YLoS). This Volume will focus on fisheries and the law of the sea in the Anthropocene Era. The book aims to provide an influential legal viewpoint on the way the corpus of rules of international law, including those governing maritime spaces and activities, addresses the multi-level and integrated nature of fisheries-related problems and opportunities in the Anthropocene era.

Contributions are sought in respect of articles examining fisheries in respect of one or more of its manifold ‘dimensions’, including human rights, environmental impact, climate change, maritime and social security, and science. This includes an examination of practical challenges, best practices and opportunities connected with the use of new socio-economic models, and regional regulatory mechanisms.

From a fisheries perspective, the declaration of a 640,000 km² "no-take" Marine Protected Area (MPA) in the Chagos Archipelago in 2010 was preceded by inadequate consideration of the scientific rationale for protection. The entire area was already a highly regulated zone which had been subject to a well-managed fisheries licensing system. The island of Diego Garcia, the only area where there is evidence of overfishing has, because of its military base, been excluded from the MPA. The no-take mandate removes the primary source of sustenance and economic sustainability of any inhabitants, thus effectively preventing the return of the original residents who were removed for political reasons in the 1960s and 1970s. The paper serves as an introduction to a dedicated special issue of the IJMCL, which comprises a number of papers looking at challenges for the external Common Fisheries Policy. The paper sets out the context of the external dimension of the EU Common Fisheries Policy and then briefly sketches out the papers in the issue. The special issue benefited from a foreword by Esa Paasivirta - a legal adviser at the European Commission and an adjunct Professor at the University of Helsinki.
