When questions of procedure are settled, the principal task of any arbitral tribunal is to establish the material facts of the dispute. It does this by examining the agreement between the parties, by considering other relevant documents (including correspondences, minutes of meetings and so on), and by hearing witnesses if necessary. The arbitral tribunal then builds its award on this foundation of facts, making its decision either on the basis of what is considered to be fair and reasonable or, mostly on the basis of law. For determination of the dispute, the arbitral tribunal may not need to go further than the confines of the agreement that is originally made between parties, if the established relevant facts do not require so. These agreements, particularly in international commerce, will generally be pretty detailed.
THRAVSMA: Contextualising Intentional Destruction of Objects in the Bronze Age Aegean and Cyprus, 2015
A survey of the iron swords from Early Iron Age (EIA) Attica and Lefkandi (1100-850 BC) in their archaeological contexts reveals interesting parallels with the swords from the Mycenae Shaft Graves (Middle Helladic III-Late Helladic II). Most of the EIA swords are bent, generally into rings, but others are interred without being damaged in any way. Significantly, bent swords are not considered by archaeologists to be any less valuable in their ancient context than the unaltered blades. Building on this approach, data from the Mycenae Shaft Grave swords will be shown to indicate that there is a rise in the fragmentation of these swords, particularly in Graves IV and V, that cannot be attributed to taphonomic processes; rather the data imply active human involvement in the fragmentation. A possible explanation for the fragmentation—and a suggestion for how the missing sword fragments were consumed—will be put forward.

The project of somaesthetics—briefly defined as the critical study and meliorative cultivation of the experience and use of one’s body as a site of sensory appreciation and creative self-fashioning—can be understood as fundamentally a philosophy of education. Somaesthetics argues that the soma—the living, purposive, sentient body—is the medium or tool through which all learning takes place. It follows that if we improve, by cultivating, the capacities of that medium or tool, we can therefore improve our capacities for learning. Moreover, the improved capacity of this medium of life and learning should make life and learning more pleasurable, and pleasure in learning will enhance our capacities to learn. Somaesthetics emerged from two main philosophical roots. First, it built on pragmatist aesthetics, which highlights the active, sentient body or soma as the necessary energetic ground and skilled medium for our capacities of artistic creation and aesthetic appreciation.
