POWER OF ATTORNEY
THIS POWER OF ATTORNEY is given this day and year stated in Section 1 of the
First Schedule hereof by the party whose particulars are stated in Section 2 of the First
Schedule hereof (hereafter called “the Donor”) of one part to the party whose particulars are
stated in Section 3 of the First Schedule hereof (hereafter called “the Donee”) of the other part.
Whereas on dated 20th August 2016 there was mutual agreement among Administrators and the
Beneficiaries of Abu Bakar’s (the Deceased Estates) and according to the Perintah
Pembahagian, Guaman Pembahagian No: JKPTG/PK/02/11/0406/2014 Tahun 2014, dated 29th
January 2015 by Pentadbir Tanah Pendang, that the Donor will transfer all his rights under the
Deceased Estates to the Donee.
NOW THIS POWER OF ATTORNEY WITHESSETH that I, the Donor do hereby appoint the
Donee in my place to exercise for me as my Attorney and for my benefit to perform the
following acts, vis:-
1.
To execute sign, seal and deliver the Transfer Form ( Borong 14A) and all other
incidental documents to convey/transfer the said Lands and/or to any intended
beneficiaries or purchasers thereof.
2.
To borrow upon the security of the said Lands or any part thereof such sums(s) of
money at such terms and subject to and with such conditions and provisions as they thin
fit for the purposes of carrying out the development of the Said Lands or any purpose as
deemed fit by the Donee.
3.
To enter into possession of the Said Lands as our Attorney shall think fit and to do all
acts as shall be advisable or necessary for the improvement of the Said Lands.
4.
To pay all taxes, quit rents, charges, expenses and other outgoings, whatsoever to be
from time to time payable or chargeable on the Said Lands or part thereof.
5.
To demand, sue for recovery and receive by all lawful 1ways and means from all and
every person whom it may concern all monies, rents, debts, tributes, due goods and
property whatsoever which now or by virtue of any judgment, decree, bill, bond,
promissory note , account or upon any investment relating thereto and upon receipt and
recovery of the same to grant sufficient acquittance releases and discharges and in case
of non-payment or non-delivery to distain to take such action in law or other
proceedings as may be necessary for the recovery of the same.
6.
To execute, sign, seal and deliver and to submit, obtain and receive any statutory
applications and all incidental documents to the relevant authority for any purposes
whatsoever as our Attorney shall think fit in respect of the said Lands.
7.
To appear before any Judge, Magistrate or any Public Officer in connection with any of
the matter herein contained. To appeal from any order of Judgment given against the
donor(s).
8.
To substitute and appoint in our said Attorney’s place and stead one or more attorney or
attorneys to exercise for us as our Attorney or Attorneys to exercise for us as our
Attorney or Attorneys any or all the powers and authorities hereby conferred and to
revoke such appointment as our Attorney from time to time think fit.
AND the Donor(s) hereby ratifies and confirms and agrees to ratify and confirm whatever the
Donee(s) shall do or purport to do in the exercise or purported exercise of all or any of the
powers, authorities and discretions referred to above.
AND the Donor(s) hereby further confirms that the appointment of such Attorney and the
power herein conferred are irrevocable for consideration of all Donor Rights and Benefits dully
received by the Donor(s) according to the Perintah Pembahagian, Guaman Pembahagian No:
JKPTG/PK/02/11/0406/2014 Tahun 2014, dated 29th January 2015 by Pentadbir Tanah Pendang.
AND the Donor(s) hereby declares that the Donee(s) shall not be held responsible or liable to
the Donor(s) for any loss or damage howsoever or whatsoever arising as a result of any act or
omissions of the Donee(s) in the execution of this instrument and any matter or thing in relation
thereof ( except where due to the gross negligence or wilful default of the Donee(s) ).
