This chapter considers key factors shaping the pursuit of gender equality and women's empowerment... more This chapter considers key factors shaping the pursuit of gender equality and women's empowerment under the SDGs. In so doing, it examines some of the most significant concerns that may militate against the goals achieving these ends. These include, the legacy of the MDGs regime and in particular the limitations that have become apparent during its operation in progressing societal change through the goals, targets, and indicators, oriented approach pioneered therein and pursued in the successor SDG regime. The chapter also discusses the tensions inherent in the adoption of a discrete gender goal on the one hand and integration of gender under other goals on the other. The principal advantage of a discrete gender goal lies in according 'headline' status to the issue; integration in other goals however offers the potential to 'mainstream' gender coverage key substantive areas. The concomitant disadvantages of these approaches are potentially 'siloing' gender issues and dilution of focus respectively. The use of indicators and their limitations, particularly in light of current levels of information and communications technology and data challenges are interrogated. The chapter concludes by examining the implications of the international community's broader evasion of the interface between goals regimes and the global human rights agenda for gender issues. Discussion centres around the fact that, as gender concerns now enjoy strong coverage in human rights law along with the legal status that this invokes, divorcing the SDGs regime from such protection stands to act to the particular disadvantage of women, negating a key route to securing accountability for the impacts of state action/inaction on the ground.

This Yearbook forms part of a long-running series issued by the respected Norwegian Fridtjof Nans... more This Yearbook forms part of a long-running series issued by the respected Norwegian Fridtjof Nansen Institute, which provides information on a wide variety of environment and development issues. The information that it supplies is widely used by a broad range of actors in the international community in developing law and policy on sustainable development. The yearbook covers a range of materials, including information on the main International Governmental Organisations (IGOs) and Non-Governmental Organisations (NGOs) operating in the sphere of sustainable development and key details on some 71 international agreements on environment and development. While these materials are useful in research terms, providing ready access to a considerable range of current factual information which would prove invaluable to a broad range of readers, this review will concentrate on some of the longer articles contained in the analytical section of the publication, that showcase significant contemporary themes in sustainable development. The Yearbook series aims to provide an analysis not only of the key international agreements relating to sustainable development, but also to provide a means for readers to assess substantive progress in reaching the goals laid out in those agreements. This edition of the Yearbook is particularly useful in that it focuses on governance issues and the development of the Johannesburg Declaration and the Plan of Development adopted following the World Summit on Sustainable Development (WSSD) in 2002. The importance of these documents cannot be underestimated as they set the scene for the current direction in progressing the sustainable development agenda.

Стремительный рост криптовалюты на мировом рынке и реализация национальной программы «Цифровая эк... more Стремительный рост криптовалюты на мировом рынке и реализация национальной программы «Цифровая экономика Российской Федерации» обуславливают актуальность исследования экологических аспектов технологии блокчейн. В качестве методологии анализа экологических аспектов была выбрана оценка рисков с использованием матрицы вероятностей. Авторами были определены и ранжированы следующие экологические аспекты криптовалюты: использование редкоземельных металлов для производства оборудования, потребление энергии для майнинга и для охлаждения вычислительной техники, выделение тепла, выбросы в атмосферный воздух, а также образование электронных отходов. Одним из наиболее важных экологических аспектов является потребление энергии. В результате проведенного исследования, сделан вывод, что используя традиционные источники энергии в технологии блокчейн, цифровая экономика будет формироваться вразрез с интересами устойчивого развития и принципами низкоуглеродной экономики. В целях реализации национальной программы «Цифровая экономика Российской Федерации», переход на возобновляемую энергетику позволит обеспечить прорыв в трансформации существующей экономической модели в цифровую без значительного ущерба окружающей среде.

Situated in this wider ecology of unhomeliness (no all encompassing oikos) and miscommunication (no unifying logos), environmental law finally faces its foundational paradox: that its conceptual limits are both potentially all-inclusive (since every societal problem can be seen as more or less environmental) and devoid of any content (since environmental law can no longer distinguish its ‘object’, namely environment per se). The traditional imaging of the environment as the thing that turns (French virer) around a stable pivot (a distilled sense of pure humanity) has been discredited in view of the collapse of the boundaries between the natural/human/artificial. In order to address this permeability, environmental law has the opportunity and responsibility to construct an adequate theoretical base for its role in environmental protection. The chapter argues for four critical environmental positions that are necessary for environmental law’s attempt at catching up both with other disciplines and the demands made to it by an ever-changing ecology. Thus, first, environmental law must theorise itself as acentric, namely conceive of itself as only one amongst a multiplicity of perspectives, none of which could ever claim to be central (yet all of them claiming precisely that); second, environmental law must de-individualise the individual and position the human in an ecological plane beyond anthropo/ecocentricity; third, environmental law must relinquish the (traditional ecological) ideal of unity and accept uncertainty as a structural and constantly present inevitability rather than an invisibilised externality; and fourth, environmental law must move beyond the illusionary construction of prescriptive idealities and focus on a measured legal description of its own limitations. Largely following a critical reading of Niklas Luhmann’s theory of autopoiesis, and influenced by postecological, feminist, spatial and other radical theoretical writings, the chapter attempts to carve a space of critique simultaneously within and outside environmental law, a mirror of ethical responsibility against which the law can measure its potential, its limits and ultimately its objects of desire. In effect, critical environmental law is an acentric, postecological, manifold and self-aware “thrown-together” of events and spaces which become ‘solid’ and relatively permanent through repetition.
