A number of labour and social security reforms adopted by EU countries in the aftermath of the 20... more A number of labour and social security reforms adopted by EU countries in the aftermath of the 2008 crisis have been challenged before national Constitutional Courts, which have sought to resolve the conflict between fundamental labour rights and conflicting economic interests, through balancing exercises. The thesis investigates the legal reasoning developed by the Italian and Spanish Constitutional Courts in crucial post-crisis judgments. The study draws on neo-constitutional theories and starts from the assumption that fundamental labour rights, understood as rights aimed at protecting workers and their dignity either during their working life or after retirement, must be fully enforced, albeit can be subject to limitations in order to protect other rights and interests constitutionally guaranteed. Il saggio ricostruisce alcune delle principali dinamiche che caratterizzano il lavoro subordinato... more Il saggio ricostruisce alcune delle principali dinamiche che caratterizzano il lavoro subordinato nel settore dell'autotrasporto all'interno dell'Unione europea mettendole in relazione con il fe-nomeno del c.d dumping sociale. L'Autrice riflette sui differenziali di costo tra i Paesi dell'Unione e affronta la questione delle cc.dd. imprese cartiere, altamente diffuse nel settore dell'autotrasporto, analizzando il rilevante quadro normativo eurounitario al fine di evidenziar-ne contraddizioni e lacune. Infine, il saggio ripercorre le tecniche di contrasto al dumping so-ciale messe in atto dal legislatore europeo, applicabili anche al settore oggetto di analisi, con particolare attenzione al coordinamento dei servizi ispettivi.

In Judgment No. 194/2018, the Italian Constitutional Court has applied Art. 24, European Social C... more In Judgment No. 194/2018, the Italian Constitutional Court has applied Art. 24, European Social Charter, as interposed parameter, in order to declare Art. 3.1, D.Lgs. 23/2015 unconstitutional, for the part that establishes a fixed and predetermined indemnity in favour of the worker, in case of unjustified dismissal. Art. 24 ESC has been interpreted in accordance with the European Committee of Social Rights’ decision in Finnish Society of Social Rights v. Finland, even though the Committee’s decisions are not considered binding by this Court, but just authoritative. The application of the ESC norm has been made possible mainly through Art. 117.1 Italian Constitution, which binds the Italian legislator to comply with international obligations, consistently with a recent constitutional precedent (Judgment No. 120/2018). Although ILO Convention No. 158/1982 is inapplicable in the Italian legal system, as the State has not signed it, the Court refers to it, by emphasising that Art. 24 ESC is inspired by that Convention, which is, at the same time, in line with the right to work protected under Art. 35.3 Italian Constitution that “promotes and encourages international agreements and organisations which have the aim of establishing and regulating labour rights”.

L'Autrice si concentra, in particolare, sui diritti di informazioni violati dall'impresa e sulle rispettive fonti normative, valorizzando il ruolo determinante degli accordi collettivi per la garanzia di effettività dei diritti di informazione.

The essay provides an analysis of the content of ILO Convention no. 94, as interpreted by the CEA... more The essay provides an analysis of the content of ILO Convention no. 94, as interpreted by the CEACR, as well as of the relevant EU legal framework, in order to clarify if and to what extent international labour law obligations differ from those set by the EU norms that protect competition and economic freedoms. The EU legal framework is extremely complex and not free from uncertainties, fuelled by a controversial case law of the Court of Justice, which has addressed, several times, the compatibility of labour clauses with the freedom to provide services. Moreover, both Directive 2014/24 and Directive 96/71 ignore ILO Convention no. 94. Consequently, an evident problem arises, especially for those States that do not provide for generally binding collective agreements, and, hence, may easily incur in violations of the internal market principles.
The aim of the paper is to provide an interpretation of the founding principles of the internal market integration harmonious with the applicable international labour standards, implemented by numerous national laws. The solution is to be found in the proper application of Article 351 TFEU, which may prevent the risk of denouncing ILO Convention no. 94. In order to avoid an irreparable conflict between EU law and ILO sources, the authors try to avoid a shallow interpretation of the standards set by the latter. They rather opt for resolving ambiguities and uncertainties of the CJEU’s case law in a way that promotes the maximum employment standards in public procurement, precisely by promoting the ILO norms, as sources that concur to define the EU general principles on labour.

Il settore del trasporto su strada nell'Unione europea è da tempo oggetto di attenzione, sia da parte di studiosi e organizzazioni sindacali, sia da parte del legislatore europeo, come dimostrato, da ultimo, dalla complessa negoziazione del Mobility Package 1 , tre iniziative concernenti il trasporto su gomma. I molti disaccordi intorno al processo di riforma appena ricordato, che riguarda svariate disposizioni del diritto dell'UE, sono significativi dell'attualità del tema e della rilevanza strategica del settore. La regolamentazione europea in materia è disarticolata; d'altro canto, sebbene essa sia ampiamente studiata, pochi lavori organici vi sono stati dedicati. Il che ha contribuito a rendere "Cross-border employment and social rights in the EU road transport sector" un libro atteso.

Una, della Corte d'appello di Brescia, 24.7.2019, decreta il carattere discriminatorio della condotta tenuta dalla società, mentre, l'altra, Tribunale di Busto Arsizio, 25.10.2019, conclude che i comportamenti della stessa Ryanair integrano una condotta antisindacale.
Le due sentenze, originate da fatti affini, offrono l'occasione per riflettere sulle analogie e le differenze esistenti tra le due azioni giudiziarie.
