This article aims to critically evaluate how the legal framework of the Schengen Information Syst... more This article aims to critically evaluate how the legal framework of the Schengen Information System (SIS) and its practical implementation have evolved to address concerns regarding the phenomenon of foreign terrorist fighters (FTFs) and which operational and fundamental rights challenges this evolution poses. In that regard, emphasis is placed on two examples: first, the article examines the maximised operationalisation of alerts on discreet checks under Article 36 of the SIS Regulation on police and judicial cooperation in criminal matters. Then, focus is placed on the forthcoming iregistration of alerts on third-country nationals in the interest of the Union based on Regulation 2022/1190. These alerts will be registered in the SIS with the increased involvement of Europol following information received by third countries or international organisations.

Introduction-Th e EU Involvement in the Criminalisation of Irregular Migration Th e past decade has witnessed the growing use of substantive criminal law as a method of tackling irregular migration. At the European level, this trend-commonly referred to as the criminalisation of irregular migration or ' crimmigration ' 1-has been fl eshed out by both the EU legislator and the Member States individually. In particular, the EU involvement takes place in a twofold manner; directly, through harmonisation of national legislation and indirectly, through the case law of the Court of Justice of the EU (CJEU). In recent years, the EU has adopted substantive criminal law provisions which treat conduct associated with irregular migration fl ows as crimes and provide for sanctions for the violation of these provisions. Th e traffi cking of human beings is a prime example in that respect, with Directive 2011/36/EU 2 substituting a pre-Lisbon Framework Decision 3 and Directive 2004/81/EC granting (conditional) residence permits rights to victims of traffi cking. 4 Human smuggling, or in more neutral EU terms, the facilitation of unauthorised entry, transit or residence, is regulated by a dual legislative framework, which mirrors the former pillar

The past three decades have witnessed the gradual evolution of a supranational system of criminal... more The past three decades have witnessed the gradual evolution of a supranational system of criminal law by the European Union. This is a striking development, since criminal law is an area of great significance for state sovereignty and national identity, whereby EU Member States have developed divergent legal traditions and understandings. Although the Treaty of Rome did not confer any express power on the then European Community (EC) in the field of criminal justice, the European integration process proved that it was difficult to disassociate Community action in the main areas of EC competence, including free movement and the completion of the internal market, from criminal justice policy. Thus, the Maastricht Treaty established a Union competence in the field of Justice and Home Affairs, under the (former) Third Pillar, including judicial and police cooperation in criminal matters. Data retention and the future of large‐scale surveillance: The evolution and contestation of judicial benchmarks

Recent and upcoming judgments of the Court of Justice of the European Union (CJEU) have resurface... more Recent and upcoming judgments of the Court of Justice of the European Union (CJEU) have resurfaced a much‐debated topic on the legal limitations of law enforcement authorities and intelligence services under EU law in implementing surveillance operations. In its decisions, the CJEU has reinstated and at times remoulded its case‐law on data retention, unearthing a variety of legal issues. This article aims to critically analyse the legal limitations of (indiscriminate) surveillance measures, the role of the private sector in the scheme, and the line between the competence of the Member States and that of the EU on national security matters. It also aims to remark on the latest developments on the reception of the decisions by the Member States and the EU legislator, as well as on the ongoing dialogue between the CJEU and the European Court of Human Rights (ECHR).
