La Explotación Sexual Comercial de Niños, Niñas y Adolescentes (ESCNNA) representa una problemáti... more La Explotación Sexual Comercial de Niños, Niñas y Adolescentes (ESCNNA) representa una problemática con múltiples causas y diferentes modalidades. Hace alusión al abuso sexual por parte de un adulto y la remuneración en dinero o en especie para el niño, niña y adolescente, o para una tercera persona, lo cual afecta la libertad e integridad sexual y el sano desarrollo de esta población. La falta de claridades, frente a la intervención judicial en los casos de la escnna, lleva a suponer la existencia de algunos vacíos que impiden ver soluciones efectivas para evitar dicha problemática; por tal motivo, se considera pertinente indagar sobre los procesos en la investigación y judicialización en la escnna. Metodología: el texto está planteado desde un enfoque multicausal que propuso la exploración de cuatro hipótesis, obtenidas a partir de diferentes intervenciones psicosociales, en los sitios de exposición de la escnna. Se realizaron tres entrevistas semiestructuradas. Hallazgos: la escnna representa una de las modalidades delictivas más preocupantes del siglo xxi, y una de las actividades ilegales más lucrativas asociada a diferentes delitos, lo que dificulta encontrar un perfil preciso; sin embargo, la confluencia de voluntades y acciones es la base para el desarrollo efectivo de la corresponsabilidad social, lo que hace que se reconozca la necesidad de fortalecer la respuesta judicial.
Abstract
Child and teenager Sexual Exploitation is a problem with multiple causes and modalities. It refers to sexual abuse by an adult and remuneration in cash to the child or adolescent or another people, which affects the freedom and sexual integrity and the healthy development of this population. The lack of clarities regarding judicial intervention in cases of escnna leads to the assumption of the existence of some gaps from seeing effective solutions to avoid this problem. So, it is appropriate to research the procedural gaps in the investigation and prosecution in escnna. Methodology: it was proposed from a multicausal approach to explore four hypotheses derived from different psychosocial interventions in exhibition sites of the escnna. Three semi-structured interviews was performed. Findings: escnna represents one of the most troubling criminal methods of the xxi century, and one of the most lucrative illegal activities associated with different wishes, making it difficult to find an accurate profile. However, the confluence of wills and actions are a base for the effective development of social responsibility, recognizing the necessity to strengthen the judicial response.
