Such is also the contemporary understanding of the function of law in democratic countries. Yet, during the Jagiellon period the law was a means, not an end. It was defined in absolute terms, as a desirable ideal state for which one should strive. Consequently, it was politics that served as a means for the realization of the goal, which was the law, and not conversely. Moreover, the view that civil law should be in accord with divine law and natural law, was widely accepted. Consequently, creating new laws required an axiological justification. Among the goals of the constitutions passed by Parliament, the legislators enumerated, among others, the wellbeing of citizens, peace, good government, order, justice. The sources of legal history illustrate the functioning of state structure and the society a traw... more The sources of legal history illustrate the functioning of state structure and the society a trawers les âges. They are doubtless cultural heritage and value. One can view them through prism that is: 1/ historical, 2/ cognitive, 3/ cultural. It is worthwhile to note that a well-prepared edition of the sources of that type facilitates smuggling their cognitive and cultural values. The editing of the sources cannot be replaced by a digitalization of the archives. Of course, the digitalization is needed (since it provides better protection of the archives than the microfilms do, and facilitates the access to the source material). However it cannot replace the function of source editing. The latter, in fact guarantees their the cognitive and cultural aspects of the source material will be brought to light. In the Kingdom of Poland, the election of a king as a successor to the throne had a long traditio... more In the Kingdom of Poland, the election of a king as a successor to the throne had a long tradition dating back in the Piast dynasty. During the Piast period in Kraków, and more specifically in the Kraków-Sandomierz Duchy, also the ruling prince was elected. The first so elected Kraków ruler, called the princeps, was Kazimierz Sprawiedliwy (Casimir the Just) (1180-1194), followed by his minor son Leszek called Biały (the White). Subsequent rulers were also elected, but the election was kept within the Piast dynasty and was, as a rule, merely a confirming election. In 1291 the throne was offered to Vaclav II of the Czech dynasty of the Przemyslids, who defeated in a military battle his rival, the Cuiavian prince Władysław Łokietek (Ladislaus, the Elbow-High).
