It reports on the fragmented status of OS policies, the different choices for provisioning infrastructure resources and services in the participating countries, and the progress to establish an EOSC perspective within their national policies.

This deliverable is a follow-up to the deliverable 2.3 Open Science in the Nordics: Legal Insights. In deliverable 2.3, use cases were selected and used to study the types of legal issues hindering cross-border research collaboration, in particular cross-border data sharing. In this deliverable, the legal constraints, as found in deliverable 2.3, have been further studied. In particular, the legal issues reported by researchers in D2.3 have been investigated from the research institution's perspective, supporting research collaborations. Based on the findings in deliverable 2.3 further interviews have been conducted with institution legal experts and other administrative personnel.

EOSC aims at making research data in Europe accessible to all researchers under the same terms of use and distribution, encouraging a culture of open research data and FAIR principles. It is the result of a long quest for innovation and collaboration started many years ago. This report maps the point of view and ongoing practices of EOSC-relevant stakeholders in 35 countries, analysing their familiarity with EOSC and Open Science principles. It gathers also information on the services they provide, on user communities and on policies in place. The European Open Science Cloud (EOSC) is foreseen to provide this federated ecosystem. To achieve this aim, efforts through a number of projects are made to understand the state of play, maturity, timelines, conformity and divergence respectively with common EU guidelines for Open Science. We look at EOSC from the perspective of the delivery chain and identify the different actors that belong to the EOSC delivery chain and map their roles and responsibilities, based on a number of service case studies. Future work will study existing cross-border collaboration models in the Nordic and Baltic countries (for publication in February 2021), and propose recommendations for future cross-border collaboration in the context of EOSC (for publication in August 2021).<br> A successful delivery chain involves many actors. Each actor plays a critical and unique role that is crucial to the delivery of the services. The deliverable is the work of Work Package two, Policies, legal issues and sustainability. This document discusses past experience of organising cross-border research, research infrastructure collaboration and access to research and infrastructure resources in the Nordic and Baltic region. It offers lessons learned with a view to the potential impact on the European Open Science Cloud (EOSC). Especially governance, resource sharing, coordination & harmonisation of policies, as well as cross-border funding are discussed. The document assesses the past developments against the anticipated EOSC model and provides recommendations on how to further develop cross-collaboration in relation to EOSC.

EOSC aims to facilitate sharing of data and resources across Europe and realise the vision of FAIR data. To realise this, legal frameworks may need to be aligned, and potential legal barriers considered. This deliverable show that not only the legislation also but also institutional polices implemented to ensure legal conformance that is a barrier for implementing cross border data sharing.<br> To illustrate this, the delivery engages with a number of use cases developed in Work Package 5 of EOSC-Nordic. Representatives for the use cases have been interviewed to show and exemplify what kind of legal issues have been recognized and how aforementioned issues may affect sharing data across the borders.
