Before June 2013, civil society and much of Congress were largely in the dark about the extent of... more Before June 2013, civil society and much of Congress were largely in the dark about the extent of the surveillance activities of the National Security Agency and the circumlocutions of statute undertaken by the White House and the Department of Justice. After the releases by Edward Snowden to specific journalists, the mendacity of Intelligence Community lawyers and leaders, the evasions of the law and manipulation of the FISA Court by the White House working with the Justice Department, and the scope of the violations of the Fourth Amendment protections of U.S. Persons (USPs) became increasingly apparent. This article reviews the changes that were initiated in the Executive Branch (and to a lesser extent in the Legislative Branch), the role civil society played in pushing and utilizing greater transparency, and what the changes mean for government accountability to the public.

When the Obama Administration released its Open Government Directive, agencies received specific ... more When the Obama Administration released its Open Government Directive, agencies received specific guidelines regarding the development of Open Government Plans. The Directive, however, did not offer agencies guidance on how to assess the attainment of open and transparent government through the implementation of their plans. This paper describes the practical realities of robust measurement of U.S. federal agency transparency and open government initiatives. The paper describes the development of a measurement framework, assessment tool, and methodology that is being used by the OpenTheGovernment.org organization and partners in 2010-11. Initial concerns about alignment with the Open Government Directive of President Obama are contrasted with critical elements, not contained within the Directive, that comprise a transparent, accountable government agency not contained within the Directive. In addition, the paper identifies psychometric issues including methods that are resilient with untrained raters as well as comparable between federal agencies. The paper presents preliminary findings using the scale the study team developed and discusses the lessons learned to date using this instrument. The paper also addresses role transparency plays in the process of developing such measures, including the importance of open engagement with all stakeholders and our experiences with online public comment tools. Finally the paper offers recommendations to those engaging in the measurement and assessment of open and transparent government, particularly as open government plans move towards implementation.
