This chapter takes stock of experiences gained through a research project on the perspective of i... more This chapter takes stock of experiences gained through a research project on the perspective of individuals accused by the International Criminal Tribunal for the Former Yugoslavia (ICTY). Using interviews, it analyses the discourse of eighteen individuals accused of having indirectly (i.e. ordered, planned, not prevented) or directly (i.e. personally committing a crime) participated in international crimes. It shows how identity positions and power relations must also be accounted for in terms of their specific implications for ethical concerns and reflexivity when carrying out such research. It discusses how the interviewees’ particular status, in its legal and political dimensions, affected the sampling procedures, the organization of the interview situation, process, its outcomes, and outputs, as well as the researchers’ roles in shaping the interview process and research outcomes. Enforced disappearance (ED) not only affects the persons who are deprived of their liberty, but a... more Enforced disappearance (ED) not only affects the persons who are deprived of their liberty, but also their next of kin who do not know what happened to their loved one. Their suffering of not knowing has been coined as “ambiguous loss” within psycho-social scholarship and is regarded in law as a form of inhumane treatment which violates the prohibition of torture. ED is attached to a complex experience of victimhood in victims they struggle for social and political recognition of the injustices they suffered. Using the social science notions of “victimhood” and “recognition” on one hand, and the legal perspectives on the other hand, we address the knowledge gap remaining regarding the interactions of the two viewpoints on the issue of ED. The workings of international criminal trials situate themselves in an era where the concept of t... more The workings of international criminal trials situate themselves in an era where the concept of truth is heralded as a key aspect in the production of understandings of the past within transitional justice (TJ) settings. Yet, in such contexts where representations of the past are multilayered, trials tend to put to the fore certain narratives as legitimate readings, while excluding many others. This article explores the discourses of 18 individuals accused by the International Criminal Tribunal for the Former Yugoslavia (ICTY). It focuses on their role as generally delegitimized agents of truth and analyzes how they reconstruct their justice experience, focusing particularly on how they make sense of the judicial truths stemming from their case. Enforced disappearance is a human rights violation and crime widely used in repression and armed ... more Enforced disappearance is a human rights violation and crime widely used in repression and armed conflict contexts. The families of the forcibly disappeared are left in a state of ambiguous loss as they search for the disappeared to satisfy their right to truth and achieve healing and closure. However, there is limited knowledge of the obstacles that hinder the search in practice and of how families can best be supported when mobilizing in search processes. Taking a multi-disciplinary approach, using insights from procedural justice research and qualitative interviews undertaken with families and other actors involved in supporting search processes in Colombia and El Salvador, we enhance and expand the scholarship that acknowledges the importance of victim participation and victims as key justice stakeholders.

Trois critères, communément admis, permettent d’appréhender une norme ou une institution juridiqu... more Trois critères, communément admis, permettent d’appréhender une norme ou une institution juridiques: sa légalité, son effectivité et sa légitimité. En droit international pénal, la légalité (des normes comme des institutions) a été questionnée très tôt (dès le procès de Nuremberg par exemple, la légalité de l’incrimination de certains actes a été critiquée) et n’a eu cesse d’attirer tous les regards depuis lors. L’effectivité, moins questionnée, prend aujourd’hui une place de plus en plus importante, notamment dans d’autres disciplines que le droit : la criminologie, la psychologie sociale ou encore la sociologie s’y intéressent de plus en plus. La légitimité, pour sa part, est restée longtemps absente des recherches en sciences juridiques comme dans les autres disciplines qui s’intéressent au droit international pénal, sans doute en partie parce qu’elle renvoie à des questionnements d’ordre moral dont le juriste peine parfois à se saisir.
