Az űrobjektumok honosságánál a tanulmány arra keresi a választ, hogy az űrobjektum honosságát adó lajstromozásnak van-e szerepe az űrobjektum által okozott károkért felelős állam azonosításában. A károkozók honosságánál a nem állami szereplők honosságának meghatározását követően azt vizsgálja a tanulmány, hogy mely állam tehető felelőssé a tevékenységükért, illetve mely állam a kárfelelős az űrobjektumok által okozott károkért nem állami szereplő érintettsége esetén. A károsult honosságánál a tanulmány azonosítja a honosság szerepét a károsultak körének meghatározásánál és a kárigényt érvényesíteni jogosult államot. Ezen kérdések elemzéséhez vizsgálat tárgyává teszi a világűrjog hatályos nemzetközi szabályozását, azok megfelelő értelmezésére és szükség esetén továbbfejlesztésére tesz javaslatokat.

The regulation of nationality, a pivotal field of constitutional law, is considered a sovereign right of the Hungarian state, which is exercised in line with Article G) of the Fundamental Law and Act No. LV of 1993 on Hungarian Citizenship. Hungarian naturalization practice, however, significantly changed in the wake of the amendment of the act concerned: Hungarians living outside the borders are entitled to preferential naturalization since 2011. This legislative action, which remarkably followed the designation of the day of conclusion of the Trianon Peace Treaty as the Day of National Unity in the previous year, was obviously influenced by historical considerations. The primary objective of preferential naturalization was to grant Hungarian nationality to persons of Hungarian origin whose ancestors had lost their Hungarian nationality in the aftermath of historical events involving the transfer of territories to neighbouring states. The study's point of departure is the Trianon Peace Treaty, the first major instrument that had a profound effect on the lives and nationality of millions of Hungarians. The study explores the peculiar interpretation and application of treaty provisions relating to territorial changes, and reveals the flaws of legal regulation which further contributed to the formation of a large community of Hungarians living outside the borders. Having surveyed the historical background, the analysis proceeds to examine the impact of historical traditions on the underling motives and current domestic regulation of preferential naturalization. Evidence includes the broad scope of eligible persons, the wide range of documents accepted to prove descent, the verification of required command of language, and the practical implementation of the procedure of naturalization. Research findings convincingly display the far-reaching effects of historical traditions on the regulation and practice of preferential naturalization in Hungary.

This was met with great alarm among Hungary's neighbours: As a consequence of the Trianon Peace Treaty in the aftermath of World War I, by which Hungary lost large swaths of its territory, a considerable part of the citizenship of Romania, Slovakia, Serbia, Ukraine and other states nowadays consists of ethnic Hungarians. Four years after, tensions between Hungary and its neighbours with respect to dual citizenship are still palpable, since the number of new Hungarian citizens increases continually and already exceeds half million. The amendment of the Hungarian Citizenship Act gives any non-Hungarian citizen, whose ascendant was a Hungarian citizen or who demonstrates the plausibility of his or her descent from Hungary and provides proof of his or her knowledge of the Hungarian language, the opportunity to apply for naturalization on preferential terms since 1 January 2011. For those who meet that description, the criteria of assured livelihood and permanent residence in Hungary no longer matter, and no exam of basic constitutional knowledge is required any more.

Article 38 of the Fundamental Law of Hungary provides that '[t]he property of the State and of lo... more Article 38 of the Fundamental Law of Hungary provides that '[t]he property of the State and of local governments shall be national assets', which shall be regulated by cardinal act. 1 The Act No. CXCVI of 2011 on National Assets (hereinafter: Act on National Assets) was accordingly adopted and entered into force on 1 January 2012, containing a prohibition for those who are entitled to dispose of national assets within the borders of Hungary to stipulate in civil law contracts records to arbitration in cases of disputes. 2 The Act No. LXXI of 1994 on Arbitration (hereinafter: Act on Arbitration) was amended by Act No. LXV of 2012 in conformity with this prohibition, precluding procedures before ad hoc or permanent arbitrary tribunals premised (seated) within or outside Hungary in cases where the subject-matter of the dispute is a national asset located in Hungary or any right, claim, demand pertaining thereto. 3 The amending act further set forth that this rule has to be applied in procedures initiated after the entry into force; that is after 13 June 2012, of the amendment. Az egyének optáláshoz való joga államutódlás esetén értelmezendő, és alkalmazására az érintett sz... more Az egyének optáláshoz való joga államutódlás esetén értelmezendő, és alkalmazására az érintett személyek vonatkozásában elsősorban szétváláskor, elszakadáskor és területátadáskor kerülhet sor. A tanulmány az optáláshoz való jogot az emigrációhoz való jogból vezeti le, az állampolgárság megválasztásának igényeként definiálja, a jog gyakorlásának a nyilatkozat megtételét tekinti, melyet az állam részéről hatósági döntés követ, és az állampolgárság megváltozása szempontjából utóbbit minősíti konstitutív aktusnak. Az elemzés kiindulópontja, hogy a nemzetközi jog jelen állása szerint az államutódlás során az államok nem kötelesek az egyének akaratát általánosságban figyelembe venni, de annak biztosítása, hogy az államhoz kötődő egyének megszerezhessék az állampolgárságot, az érintett államok és egyének érdeke egyaránt. Emellett rávilágít arra a problémára, hogy az optáláshoz való jog főként eseti jelleggel kerül szabályozásra, és nem mutatható ki egységesség a jog alanyai, formai és időbeli keretei, az állampolgárságra gyakorolt hatása, valamint a más járulékos következményeit tekintve sem. A szabályozás hiányosságai és nem megfelelő megoldásai ugyanis de jure vagy de facto hontalansághoz vagy nem kívánt kettős állampolgársághoz vezethetnek. A tanulmány célja, hogy megadja az egyes vitatott jellemzők leginkább elfogadható megoldásait, melyhez elengedhetetlen az elméleti viták és a különböző gyakorlati megoldások számbavétele. A vizsgálat során az európai esetek túlsúlya az optáláshoz való jog biztosításának történelmi és területi elterjedéséből fakad. Az optáláshoz való jog átfogó elemzésével a tanulmány a magyar szakirodalomban mindezidáig fellelhető hiányosság pótlására vállalkozik.
According to the recent amendment of the Hungarian Citizenship Act, Hungarians living outside the... more According to the recent amendment of the Hungarian Citizenship Act, Hungarians living outside the borders can acquire an additional nationality, and become dual or multiple nationals. The study analyses the prohibition or recognition of dual nationality and the relevant practice of neighbouring states as the main purpose of the amendment was to enable Hungarians living in territories detached owing to historical events to acquire nationality. By assuming international obligations states may limit their discretion in matters of nationality, which otherwise fall within the domestic jurisdiction of states. Human rights drive the regulation of nationality in certain cases all the more towards the realm of international law. For that reason, human rights limiting the regulation of nationality, such as the right to a nationality, the prohibition of (arbitrary) deprivation of nationality and the prohibition of discrimination, also need to be examined. The analysis also extends to the lack of effectiveness of nationality of Hungarians concerned as well as the binding nature of the principle of effectiveness. The study concludes that the principle of effectiveness may not serve as a basis for other states to declare non-recognition of nationality of these individuals. Finally, obligations under bilateral treaties on good neighbourliness, confi dence and friendly cooperation concluded by Hungary and several neighbouring states between 1992 and 1996 are taken into consideration, as well.

The concept of socialist law expresses the ideological legacy of Marxism-Leninism. It was understood by its proponents as the expression of will of the working class, an instrument of class struggle as well as a means for building a communist society. The article examines the extent to which socialist law fits into any concept of law, in light of the fact that its roots were totalitarian, and it had a purely instrumental legitimacy. The authors also introduce the development, structure, substantive and procedural institutions of socialist law, along with the socialist administration of justice and perception of international law.

Az egyének optáláshoz való joga államutódlás esetén értelmezendő, és alkalmazására az érintett sz... more Az egyének optáláshoz való joga államutódlás esetén értelmezendő, és alkalmazására az érintett személyek vonatkozásában elsősorban szétváláskor, elszakadáskor és területátadáskor kerülhet sor. A tanulmány az optáláshoz való jogot az emigrációhoz való jogból vezeti le, az állampolgárság megválasztásának igényeként definiálja, a jog gyakorlásának a nyilatkozat megtételét tekinti, melyet az állam részéről hatósági döntés követ, és az állampolgárság megváltozása szempontjából utóbbit minősíti konstitutív aktusnak. Az elemzés kiindulópontja, hogy a nemzetközi jog jelen állása szerint az államutódlás során az államok nem kötelesek az egyének akaratát általánosságban figyelembe venni, de annak biztosítása, hogy az államhoz kötődő egyének megszerezhessék az állampolgárságot, az érintett államok és egyének érdeke egyaránt. Emellett rávilágít arra a problémára, hogy az optáláshoz való jog főként eseti jelleggel kerül szabályozásra, és nem mutatható ki egységesség a jog alanyai, formai és időbeli keretei, az állampolgárságra gyakorolt hatása, valamint a más járulékos következményeit tekintve sem. A szabályozás hiányosságai és nem megfelelő megoldásai ugyanis de jure vagy de facto hontalansághoz vagy nem kívánt kettős állampolgársághoz vezethetnek. A tanulmány célja, hogy megadja az egyes vitatott jellemzők leginkább elfogadható megoldásait, melyhez elengedhetetlen az elméleti viták és a különböző gyakorlati megoldások számbavétele. A vizsgálat során az európai esetek túlsúlya az optáláshoz való jog biztosításának történelmi és területi elterjedéséből fakad. Az optáláshoz való jog átfogó elemzésével a tanulmány a magyar szakirodalomban mindezidáig fellelhető hiányosság pótlására vállalkozik.
According to the recent amendment of the Hungarian Citizenship Act, Hungarians living outside the... more According to the recent amendment of the Hungarian Citizenship Act, Hungarians living outside the borders can acquire an additional nationality, and become dual or multiple nationals. The study analyses the prohibition or recognition of dual nationality and the relevant practice of neighbouring states as the main purpose of the amendment was to enable Hungarians living in territories detached owing to historical events to acquire nationality. By assuming international obligations states may limit their discretion in matters of nationality, which otherwise fall within the domestic jurisdiction of states. Human rights drive the regulation of nationality in certain cases all the more towards the realm of international law. For that reason, human rights limiting the regulation of nationality, such as the right to a nationality, the prohibition of (arbitrary) deprivation of nationality and the prohibition of discrimination, also need to be examined. The analysis also extends to the lack of effectiveness of nationality of Hungarians concerned as well as the binding nature of the principle of effectiveness. The study concludes that the principle of effectiveness may not serve as a basis for other states to declare non-recognition of nationality of these individuals. Finally, obligations under bilateral treaties on good neighbourliness, confi dence and friendly cooperation concluded by Hungary and several neighbouring states between 1992 and 1996 are taken into consideration, as well.

The concept of socialist law expresses the ideological legacy of Marxism-Leninism. It was understood by its proponents as the expression of will of the working class, an instrument of class struggle as well as a means for building a communist society. The article examines the extent to which socialist law fits into any concept of law, in light of the fact that its roots were totalitarian, and it had a purely instrumental legitimacy. The authors also introduce the development, structure, substantive and procedural institutions of socialist law, along with the socialist administration of justice and perception of international law.
