You can use the template {{rfu}} to do this. Discussion about this file's non-free use began at WT:NFCC#File:Alexandria Virginia sheriffs office photo of Enrique Tarrio.png, but I'm moving the discussion here to seek wider input from the community. Basically, this is a case of WP:DECORATIVE non-free use in Enrique Tarrio#January 6 attack and seditious conspiracy conviction which fails WP:NFCC#8. There's not really anything historic about this photo per se per WP:ITSHISTORIC and there's already a free image of Tarrio being used for primary identification purposes in the main infobox of the article per WP:FREER. Moreover, there's also no sourced critical commentary about the mugshot itself or about how Tarrio's appearance either in this mugshot or during his trial was so vastly different from how he looked on January 6 or in other similar photos with baseball cap and sunglasses which might provide justification for non-free use per WP:NFC#CS and require readers to see to understand anything that's written about Tarrio in that section of the article. -- Marchjuly (talk) 09:32, 12 November 2023 (UTC)
- Tarrio isn't fully identifiable in the the free image; in public he wore sunglasses and baseball hat which obscures his features. If it would assuage your concerns, we could swap the order of the images and put this image in the infobox at the top -- it's well-established we can use a fair use image in that context. I think it's better to put the images in chronological order, but not if exercising editorial discretion over placement will lead to deletion. Additionally there is a editorial interest in including a mugshot of a person known for their criminal behavior. It takes a very high bar to include a mugshot in a BLP (WP:MUG), but when that bar is finally met after a high profile criminal conviction and sentencing, the Fair Use Policy concerns are undoubtedly met -- the image is a government work with no commercial opportunity. - Clear delete; the image is a non-free image of a living person. There is no particular historical significance to the mugshot that informs the BLP where it remains. We already have a free license image available in the infobox. Moving the non-free image to the infobox doesn't change requirements under WP:NFCC. Yes, it's a government work, but not a federal work. The image is encumbered with copyrights, and must meet or exceed all elements of WP:NFCC, which it does not. To the person closing this discussion; please note that per WP:NFCC, there needs to be a consensus to include the image somewhere, not a consensus to remove it. Non-free images are not, by default, acceptable and thus require consensus to remove, per burden of proof at WP:NFCC. - Delete: I have to agree with Hammersoft. This does not pass all 10 WP:NFCC requirements. There is a freely licenced image which you just don't like but we have worse images of some people, so that's not a good reason to keep and because he is still living, at some time a better free image could be made. ww2censor (talk) 00:59, 13 November 2023 (UTC)

- By the virtue of simply being a mugshot, the answer would be "no". If it was taken by an employee of the US federal government as part of their official duties, however, then it would be PD per WP:PD#US government works. Figuring things at the sub-national level can be trickier since it depends upon the laws/statutes of the individual state. California and Florida have statutes on the books that make certain works created by state, country and other municipal employees as part of their official duties PD, but most US states don't. Virginia is listed as "probably but unclear" by Harvard's State Resource Copyright Center, but I'm not sure if that's enough for us to make such a declaration here. -- Marchjuly (talk) 09:15, 19 November 2023 (UTC)
