Artículo 35.2 del Real Decreto Legislativo 1/1996 de 12 de abril, por el que se aprueba el texto refundido de la Ley de Propiedad Intelectual, que permite la utilización de las obras, de cualquier naturaleza, ubicadas permanentemente en las vías públicas. El artículo establece que: «Las obras situadas permanentemente en parques, calles, plazas u otras vías públicas pueden ser reproducidas, distribuidas y comunicadas libremente por medio de pinturas, dibujos, fotografías y procedimientos audiovisuales».
