Panoramafreiheit in Slovakia

[edit]

I added Slovakia to the list of countries with Panoramafreiheit, based on this free translation by User:Maros:

Slovak copyright law is here. I guess you do not speak Slovak... I am not a lawyer, but I can try my best to clarify the situation with sculptures in Slovakia :-). Here is probably the relevant part (I hope I am not breaking copyright law by putting it here):

                  § 27
Použitie diela umiestneného na verejnom
priestranstve
(1) Bez súhlasu autora možno dielo trvalo umiestnené
na verejnom priestranstve vyjadriť kresbou, maľbou,
grafikou, reliéfnym obrázkom či reliéfnym modelom
alebo ho zaznamenať fotografiou či filmom; takto
vyjadrené alebo zaznamenané dielo možno bez súhlasu
autora diela trvalo umiestneného na verejnom priestranstve
použiť vyhotovením jeho rozmnoženiny, jej
verejným rozširovaním predajom alebo inou formou
prevodu vlastníckeho práva, alebo verejným prenosom.
Na tieto použitia sa primerane vzťahuje ustanovenie
§ 25 tretia veta.
(2) Za použitie diela podľa odseku 1 nevzniká povinnosť
uhradiť autorovi odmenu.

Free translation:

                  § 27
Use of a work that is located on a public place
(1) Work that is permanently located on a public place
could be expressed by a drawing, painting, graphic art,
relief picture, relief model or recorded both as a movie
or photograph without permission of an author;
<here it is unfortunately very unclear to me what they want
to say - very strange formulation, but I try :-(> Such a expression
or recording of a work that is permanently located on a public place
could be without permission of the author used by its copying,
selling, other kind of property transfer.
For such a use applies adequately third sentence of § 25
(2) For using a work according paragraph 1 there is no obligation
to pay the author.

For completition, the third sentence of § 25:

Pri citácii sa musí uviesť meno autora alebo jeho pseudonym,
ak nejde o anonymné dielo, alebo meno osoby, pod ktorej menom sa dielo
uvádza na verejnosti, ako aj názov diela a prameň

In short:

By citing, you have to use a name of author or his/her pseudonym...
+ name of the work and source.

I hope it clarify the situation a bit. --Maros 23:09, 19 July 2006 (UTC)[reply]
