- According to the Minnesota Government Data Practices Act, which includes any 'work' produced by the government, "the public's right of access to and use of public government data cannot be curtailed by a government entity's claim of intellectual property rights in those data" See [1] StanTheMan87 (talk) 18:26, 15 October 2015 (UTC)
- The license incorrectly used on the image states "This work is in the public domain in the United States because it is a work prepared by an officer or employee of the United States Government as part of that person’s official duties under the terms of Title 17, Chapter 1, Section 105 of the US Code. . . . Note: This only applies to original works of the Federal Government and not to the work of any individual U.S. state, territory, commonwealth, county, municipality, or any other subdivision." The advisory opinion you linked above does not state that materials produced by the State of Minnesota are to be treated the same as those by the Federal Government. - No, you're wrong. Please reread what I wrote above. The image is able to be accessed and used by the public without any potential copyright or claim of intellectual property obstruction. Case closed. And on the licensing, just change the license if the original uploader used the wrong one. It is a permissible file and is in the Public Domain.
