Category description of Category:Emmy Awards says clearly: "Please note: The Emmy Award sculpture is still copyrighted. Please do not upload any image soley showing the award (e.g. without an award winner holding it)." In this photo, the award (resp. a reproduction of it?) is the major part of the image and certainly not de minimis - so I think, even if the photo itself was released under CC-BY-SA 2.0 by the photographer, we can't keep it.
