- @Shiftchange: You're not on Wikipedia anymore. This is Commons. You should have indicated the license of the original for derivative works. I looked it up: "The 2nd edition of "Mastering Bitcoin" is available under a CC-BY-NC-ND license, not a CC-BY-SA license". While it does not matter here, CC-BY-NC-ND is not acceptable for Commons. "Cover Designer: Randy Comer". Which also doesn't matter! Because "The cover image is from Insects Abroad". - It should be noted that Jane955 is in fact the person who uploaded this file, which has been tagged as a derivative work, for which the sources are not provided. I would be very surprised if this image was not uploaded in breach of copyright. For that reason, and because Commons is not a repository for ill-informed propaganda works, it should be deleted. Please delete, at the time the maps were created there was a discussion about changing the model of the maps, however, the maps that I created did not have an acceptable quality in the pages, because in smaller resolutions it is difficult to see the borders. - There may have been a problem saving the file, but I have not changed the file extension when editing it. I do not think this problem is so serious if the images are placed in the optimal resolution and it would be very laborious to have to upload all of them again. - Indeed those two photos do not, but their credibility as works by 'karel fuentes' are just as low. Note that the first photo by Jeffrey Noble also uses the same camera as "Hugo Chavez.jpg" despite not having his name itself marked. There it clearly states "(Photo by Andrew H. Walker/Getty Images for Yahoo News)" (emphasis there mine). So we've verified the Getty part of the chain. The fact that it clearly states thet it's Getty for Yahoo means that Getty is taking the shots on behalf of Yahoo. Which means it's a work for hire situation. - Keep - I noticed this when this user's multiple VIs (which I nominated) and other in-use images were tagged for deletion (since removed from the nomination -- thanks). Those that are not in use are nonetheless in scope. They are images from an in-person Wikimedia event, which are typically considered to be in scope. Such events are typically also "upload notable people to Commons" events (they don't always actually meet the threshold of notability, but they are artists and others we typically consider to be in scope, as opposed to say, selfies or the uploader's family. - Keep Jesus, just because images are from getty doesn't automatically make them not free, getty photographers are paid by companies/organisations to take pictures, the Benn Northover image is moot cause that image clearly says "Getty Images for Chanel" thus an OTRS permission was sought cause that image was not paid for by Chanel for its free use whereas all the images i added were from the OFFICIAL Yahoo news Flickr feed so they paid for the rights to those images and thus can freely release it under any licences they choose cause even the photographer has specifically stated that theses images were taken for "yahoo news". Can people who don't understand copyright laws please avoid trying to tag everything they see, there are other ways to becoming admins. this was discussed before, i'm technically retired so i don't like coming here to teach kids how to play..--Stemoc 15:24, 26 July 2018 (UTC)
- Keep The set can be found on the Wireimage website at http://www.wireimage.com/search/#events?q=[488128989]&ep=2/60/1&s=3 where it learly states for every image "(Photo by Andrew H. Walker/Getty Images for Yahoo News)" (emphasis there mine). So we've verified the Getty part of the chain. The fact that it clearly states thet it's Getty for Yahoo means that Getty is taking the shots on behalf of Yahoo. Which means it's a work for hire situation. Which means Yahoo can do as they wish with the images. In this case, posting it to a Flickr account with a Wiki-friendly license statement. Tabercil (talk) 14:38, 28 July 2018 (UTC)

On paper, the copyright holder will most likely be Getty but whoever the photos were made for (Chanel, TechCrunch, Yahoo) has been granted an unlimited non-exclusive, sub-licensable worldwide license. (it's virtually impossible this is not the case, Getty rights experts have looked at this) Alternatively it's the other way around: Chanel, TechCrunch and Yahoo are the copyright holders and have granted Getty an unlimited non-exclusive, sub-licensable worldwide license. - The TechCrunch deletion was actually a big mess-up by the deleting admin, you have to realise, a few of our admins actually have no idea about some of the copyright rules, they didn't become admins because they know those laws, they did it by the "other" reason..and the deleting admin in that DR is always in hotwater, not sure why no other admins did anything about this (oh yeah now i remember, they give their balls in exchange for admin rights on wikiMedia), that said, again Getty is NOT the copyright holder, they are an agent, whatever the photographer does with their images is none of their concern, their job is to "sell" their images, the photographer makes the rules, not the agent. If someone wants to "pay" for the use of those images, they are more than welcome to but as it stands, the rights to those images belongs to Andrew and the people who paid him for those images, which in this case is Yahoo News, the former explicitly stated he was taking images for that event which means he has explicitly given Yahoo News his permission and the latter who owns the images are free to release them whichever way they want. Its a shame most of the admins who knew all this are long gone but alas we have to deal with n00bile editors and admins who might as well end up deleting everything if they so choose because people who question them are either shut down or ignored...--Stemoc 13:03, 31 July 2018 (UTC)
- @Stemoc: Chanel/Techcrunch/Yahoo calls Getty to take pictures of their event, they deal with Getty, not photographers. Photographers who work for Getty would have to sign a contract. That contract includes clauses to make sure the photographer won't be the copyright holder. - While I didn't get a clear answer from anyone (merely pointed to their ticket system - I could send a message from [email protected], but...), but from what I could desipher (do not quote me on this, or decide based on my comment) the photographer is the copyright holder, and Getty is the copyright holder's authorized seller of licenses. In cases such as this, a client does hire a photographer (a stringer or freelancer) via Getty (who contacts the photographer), and allows the client to use the image in perpetuity, while the photographer retains the copyright. I was then pointed to https://www.gettyimages.com/eula and https://wonderfulmachine.com/images/blog/2014/02/14_getty_global_assignment_contract.pdf --Jonatan Svensson Glad (talk) 16:07, 28 August 2018 (UTC)

Deleted: the most likely situation is that Andrew H. Walker is the copyright holder and that Yahoo has a usage right. This is consistent with what Jonatan wrote and also with ticket:2014120410004011, from which we do know that Andrew H. Walker has been prepared in the past to release one of their pictures into CC-BY-SA 4.0. It may be worth trying to contact him to ask for permission (and to send this permission to OTRS). - @GRuban: not completely. The closing rationale was "the most likely situation is that Andrew H. Walker is the copyright holder and that Yahoo has a usage right". As we see here, and I have said this before in similar cases, the photographer doesn't hold (or doesn't manage) the copyright and we're asking someone who knows about as little as we do. Getty is, probably, legally the copyright holder. Getty also knows a lot about copyright infringement and a part of their services is "Offering uncapped indemnification, our team of legal pros make sure your imagery won't cause unnecessary rights and clearance headaches." These guys don't fuck around. So we can go two ways from here:
- Assume those Getty legal pros are a bunch of completely retarded idiots who don't know what Flickr or Creative Commons is, and Wikimedia Commons users are way better than them
- Assume Getty, Yahoo and TechCrunch are grown-ups who understand contracts
